Terms and Conditions

I. For purposes of this agreement, WebLM is referred to as "WebLM" or "Company" or "we", Melaleuca, Inc. is referred to as "Melaleuca" and the other party to this Agreement is referred to as "User" or "you".

II. WebLM, and from time to time Melaleuca, can and will review pages for content before they are posted, and will review and verify the contents of any User-created pages. We reserve the right to remove any page from the web site hosting servers, which we, in our sole discretion, determine is in violation of our rules and guidelines. All policies and procedures referenced in Melaleuca policies and procedures and the content of the document 'Melaleuca Guidelines on Internet Usage' must be followed. This notwithstanding, Users are solely responsible for all content contained on their own web site, and can be held legally liable for the contents of their website.

III. Company may terminate User accounts at any time, without notice for conduct that violates these guidelines, or for any other reason in our sole discretion, and may terminate User accounts and delete any and all User information for conduct that Company believes is harmful to the business of Company, or any of its Users or partners. Pages found in violation of these items may be subject to immediate deletion and removal from web site hosting servers. Ultimately the User is responsible for all content on his/her website and will be held responsible for any violations. The following is a non-exclusive list of content and behavior that are UNACCEPTABLE: (a) Content that contains or contains links to: nudity, pornography, adult content, sex, or foul language; (b) Content that condones, promotes, contains, or links to, warez, cracks, hacks, their associated utilities, or other piracy related information, whether for educational purposes or not; (c) Content that has been promoted through the sending of unsolicited email (spamming) or mail fraud schemes, or pages that promote or condone the sending of unsolicited email. Users who utilize company resources, including email addresses for spam are also subject to prosecution to the fullest extent of the law; (d) Content that commits acts of copyright, trademark, patent, trade secret or other intellectual property infringement; (e) Content that is racist, or otherwise extremely offensive to others by virtue of race, gender or religion, including content which aggravates, harasses, threatens, defames, or abuses others; (f) Storage of log files or non-html content, or any use of space that circumvents the display of advertising; (g) Websites that exploit images of children under 18 years of age; (h). Binary files, downloads, etc. that are not linked to an html page on the Users website, such that an advertising banner is displayed. (i) information or content on a website that makes false or misleading claims about Melaleuca products and services; (j) information or content on a website that makes claims, representations, promises or warranties that are either untrue, or in violation of applicable federal and state laws or are in violation of Melaleuca policies and procedures. (k) Content that is deemed by company not to be in accordance with the 'Melaleuca Guidelines on Internet Usage'.

IV. Company provides space for hosting web pages but makes no implied or express warranties about the reliability of this space or related services. Company is not responsible for any deletion, alteration, or loss of data due to network or system outages, file corruption, accidental deletion, or any other reasons. Company makes no guarantees as to server reliability, speed, or consistency, and cannot be held liable for such. (a). Users are responsible for regularly monitoring and creating backups of their own files, and agree to use the web site resources and infrastructure at their own risk. (b) This service is provided on an "as is" basis without warranties of any kind, either expressed or implied. Company does not make any warranty with respect to any content, information, services, or products provided through or in conjunction with this service. (c). Company makes no guarantee of the accuracy, correctness, or completeness of any information on these web pages and are not responsible for any errors or omissions arising from the use of such information; any failures, delays, or interruptions in the delivery of any content or services contained on our servers; or losses or damages arising from the use of the content or services provided by Company. (d). Company may also link to or include on its website resources and information provided by 3rd party partners and providers. We do not guarantee the reliability of this information, nor does the inclusion of this information imply our recommendation of these services; it is merely available to provide added value to our service. (e). You agree to indemnify Company against any and all claims and expenses, including attorneys' fees, arising from your use of this service. This expressly includes your responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and any libelous or unlawful material contained within your website.

V. Users may not display other forms of paid or exchange advertising on their website, other than through those programs and incentives offered by Melaleuca.

VI. Other Company rules and guidelines: (a). Each user is responsible for creating and updating his/her web page, and regularly backing up any related data. WebLM will provide backups on a daily basis but User is ultimately responsible for backing up any specific content entered by User.

VII. Company reserves the right to amend or change these guidelines at any time without notice.

VIII. The terms contained in the Marketing Executive Application/Agreement and Marketing Executive Policies and Procedures between Melaleuca and User as well as the Marketing Executive rules and restrictions contained in the 'Melaleuca Guidelines on Internet Usage' document are included herein by this reference and made a part of these Terms and Conditions.

IX. Company covenants and agrees that all services provided to User under this Agreement will comply with Melaleuca, Inc.'s policies and guidelines on Internet usage.

X. The offered 30-day money back guarantee expires 30 days from the date of sign-up. No partial refunds are given for cancellation after 30 days.
